1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers and businesses through our online shop on the website thewineandmore.com.
2. Contracting Party and Conclusion of Contract
The purchase contract is concluded with Wine&More GmbH. By displaying the products in our online shop, we make a binding offer to conclude a contract for these items. The contract is formed when the customer submits the order by clicking the “Buy Now” button and receives an order confirmation by e-mail.
3. Protection of Minors / Age Verification
The sale of alcoholic beverages is restricted to persons over 18 years of age. By placing an order, the customer confirms that they are of legal age. Delivery is made exclusively with age verification (DPD Age Check 18+).
4. Prices and Shipping Costs
All prices are final prices in euros, including statutory VAT. Shipping costs are charged additionally and are shown before the order is completed.
5. Delivery
Delivery is carried out by DPD within Germany and the EU. Self-collection is possible by prior arrangement. The delivery time is usually 2–5 working days.
6. Payment Methods
Payments are processed via the Viva.com platform. Various payment methods are available (e.g. credit card, instant bank transfer, etc.).
7. Right of Withdrawal
Consumers have a statutory right of withdrawal in accordance with § 355 of the German Civil Code (BGB). Details can be found in our separate Withdrawal Policy.
8. Retention of Title
The goods remain the property of Wine&More GmbH until full payment has been received.
9. Warranty and Liability
The statutory warranty rights apply. We shall only be liable for claims for damages caused by us, our legal representatives, or vicarious agents in cases of intent or gross negligence.
10. Applicable Law and Place of Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Munich, insofar as legally permissible.
